Terms of Use
The terms on which we provide this website and our brokerage services.
Effective Date: October 6, 2026 · Last Updated: October 6, 2026
PLEASE READ THESE TERMS CAREFULLY. Section 14 contains a binding individual arbitration agreement and class action waiver that applies to users who do not reside in California, with a 30-day right to opt out. Section 15 contains an exclusive court forum, jury waiver, and class action waiver for California residents. Both affect how disputes with us are resolved.
1. Acceptance of These Terms
These Terms of Use (the "Terms") are a legally binding agreement between you and FindYourDomain.com ("FindYourDomain," "we," "us," or "our") governing your access to and use of www.findyourdomain.com (the "Site"), our contact and inquiry forms, and any communications with us about buying, selling, or brokering domain names (together, the "Services"). By accessing or using the Site, submitting an inquiry, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site or Services.
If you use the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity, and "you" refers to both you and the entity.
2. Eligibility
The Site and Services are intended for businesses and for individuals who are at least 18 years old and capable of forming a binding contract. By using the Services you represent that you meet these requirements, that you are not located in, or a national or resident of, a country or territory subject to comprehensive U.S. sanctions, and that you are not listed on any U.S. government restricted-party list (including the OFAC Specially Designated Nationals list).
3. Our Services; No Transaction Is Formed Through the Site
FindYourDomain helps companies and individuals identify, value, acquire, and sell domain names, and provides brokerage services for domain name owners. The Site provides general information about those Services and a way to contact us.
No offer or contract through the Site. Nothing on the Site is an offer to sell or buy any domain name, and no agreement to buy, sell, broker, or transfer a domain name is formed by your use of the Site, by submitting an inquiry, or by any exchange of emails or calls, unless and until a separate written agreement (such as an engagement agreement, purchase agreement, or executed escrow instructions) is signed by both you and FindYourDomain or by the parties to the transaction (a "Transaction Agreement"). Any domain name mentioned on the Site or in our communications is subject to prior sale, withdrawal, and price change without notice.
Transaction Agreements control. Each Transaction Agreement governs the transaction it covers. If a Transaction Agreement conflicts with these Terms, the Transaction Agreement controls as to that transaction. These Terms continue to govern your use of the Site and all other aspects of our relationship.
No obligation to act. We may decline any inquiry, decline to pursue any domain name, or stop work on any matter at any time, for any reason, without liability, unless a signed Transaction Agreement provides otherwise.
4. Brokerage Disclosures
You acknowledge and agree that:
- We may represent either side. FindYourDomain may act for buyers, for sellers, or, with disclosure, for both parties in the same transaction. Unless a signed Transaction Agreement expressly states that we represent you exclusively, we do not represent you and may represent the other party.
- We may own domains we offer. FindYourDomain and its affiliates and principals own domain names and may offer domain names in which we or they have a direct or indirect ownership interest. We are not required to disclose the identity of a seller or buyer, or our interest in a domain, except as required by law or a Transaction Agreement.
- We are not a fiduciary, lawyer, or appraiser. We are not your agent or fiduciary, and we do not provide legal, tax, trademark, or investment advice. Any price range, estimate, valuation, comparable sale, or opinion we provide is a non-binding estimate based on our experience and publicly available information, is not an appraisal, and is not a guarantee of value, resale value, or that any transaction will close at any price.
- Compensation. Our commissions, fees, and any spread between a purchase price and a resale price are disclosed in the applicable Transaction Agreement. You are responsible for your own costs, including registrar, escrow, legal, and transfer fees, unless a Transaction Agreement provides otherwise.
- No exclusivity; no confidentiality unless agreed. Unless a signed Transaction Agreement provides otherwise, neither party is bound to exclusivity, and information you send us through the Site or by email is not confidential, though we will handle personal information as described in our Privacy Policy. Do not send us trade secrets or confidential business plans without a signed confidentiality agreement.
- Third parties. Domain transfers, payments, and escrow are performed by independent registrars, registries, and escrow providers (for example, Escrow.com) under their own terms. We do not control them and are not responsible for their acts, omissions, delays, fees, or policies, including registrar transfer locks and ICANN transfer rules.
5. Inquiries and Communications
When you submit our contact form or otherwise contact us, you agree to provide accurate and complete information and to keep it current. You consent to our contacting you by email and telephone at the addresses and numbers you provide, including to respond to your inquiry, to discuss domain names you may be interested in, and to send marketing communications about our Services. You may opt out of marketing emails at any time as described in our Privacy Policy. We do not send marketing text messages. Calls may be monitored or recorded where permitted by law and with any required notice.
By identifying a domain name you wish to buy or sell, you authorize us to contact the domain's registrant, prospective buyers, registrars, and other parties as reasonably necessary to evaluate and pursue your inquiry, and you acknowledge that we may disclose that you have expressed interest in a domain name as needed for that purpose, as described in our Privacy Policy. We will not disclose your identity to a counterparty without your direction, except as required to complete a transaction you have asked us to carry out.
6. Trademarks, Domain Disputes, and Your Responsibilities
Domain names can conflict with trademarks and other rights. You are solely responsible for determining whether any domain name you seek to acquire, sell, or use infringes or dilutes the rights of others, and for how you use any domain name. You represent, warrant, and agree that:
- you have conducted, or will conduct, your own trademark and legal clearance for any domain name you acquire, and you are not relying on us for that clearance;
- your acquisition, sale, and use of any domain name will not infringe, dilute, or violate any trademark, trade name, right of publicity, or other right of any third party, and will not violate any law, including the Anticybersquatting Consumer Protection Act (15 U.S.C. § 1125(d));
- if you are a seller, you are the registrant or are authorized by the registrant to sell the domain name, the domain name is not subject to any lien, dispute, UDRP or URS proceeding, court order, or registrar hold, and you have not acquired or used it in bad faith;
- you will not use the Services in connection with phishing, malware, counterfeiting, spam, or any other abusive or unlawful activity; and
- FindYourDomain makes no representation that any domain name is free of third-party claims, and we have no liability for the outcome of any Uniform Domain Name Dispute Resolution Policy (UDRP), Uniform Rapid Suspension (URS), ACPA, or other proceeding or claim concerning any domain name, whether brought before, during, or after a transaction.
7. Acceptable Use
You agree not to, and not to permit others to: use the Site for any unlawful purpose; use bots, scrapers, or automated means to access, harvest, or index the Site or any domain name lists or pricing information; attempt to probe, scan, or test the vulnerability of the Site or circumvent any security measure; submit false, misleading, or fraudulent inquiries, or impersonate any person or entity; interfere with the operation of the Site or any other user's use of it; use the Site to transmit malware or unsolicited commercial messages; frame or mirror any part of the Site; or reverse engineer any software used to provide the Site. We may investigate violations and may suspend or block access to the Site at any time without notice.
8. Intellectual Property
The Site and all content on it, including text, graphics, logos, images, domain name lists, pricing information, software, and the selection and arrangement of the foregoing (the "Content"), are owned by FindYourDomain or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site and Content for your personal or internal business use in considering our Services. All other rights are reserved. "FindYourDomain," "Find Your Domain," and our logos are trademarks of FindYourDomain or its affiliates; you may not use them without our prior written permission. Other names and marks on the Site, including domain names offered for sale, belong to their respective owners.
If you send us suggestions, ideas, or feedback about the Site or Services, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without obligation to you.
9. Third-Party Websites and Services
The Site may link to third-party websites and services, including registrars, escrow providers, and social media platforms. Those sites and services are not under our control, and we are not responsible for their content, availability, policies, or practices. Links do not imply endorsement. Your dealings with any third party are solely between you and that third party.
10. Disclaimer of Warranties
THE SITE, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, FINDYOURDOMAIN AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS (THE "FINDYOURDOMAIN PARTIES") DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, THE FINDYOURDOMAIN PARTIES MAKE NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT ANY DOMAIN NAME IS AVAILABLE, ACCURATELY DESCRIBED, OR FREE OF THIRD-PARTY CLAIMS; THAT ANY VALUATION OR ESTIMATE IS ACCURATE; OR THAT ANY TRANSACTION WILL BE COMPLETED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE FINDYOURDOMAIN PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OPPORTUNITY, OR FOR THE COST OF SUBSTITUTE SERVICES OR DOMAIN NAMES, ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, THE SERVICES, OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE FINDYOURDOMAIN PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, THE SERVICES, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE FEES YOU PAID TO FINDYOURDOMAIN UNDER THESE TERMS IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. LIABILITY ARISING UNDER A TRANSACTION AGREEMENT IS GOVERNED BY THAT AGREEMENT. THE LIMITATIONS IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US AND WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the FindYourDomain Parties from and against all claims, demands, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site or Services; (b) your breach of these Terms, including any representation or warranty in Section 6; (c) your acquisition, sale, or use of any domain name, including any claim that a domain name or its use infringes or violates the rights of a third party or any law, and any UDRP, URS, ACPA, or similar proceeding; or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification at your expense, and you agree to cooperate with our defense. This Section does not apply to the extent a claim results from the gross negligence or willful misconduct of a FindYourDomain Party, and it does not apply to California residents to the extent prohibited by California law.
13. Informal Dispute Resolution (All Users)
Most concerns can be resolved quickly and informally. Before starting any arbitration or lawsuit against the other, you and FindYourDomain each agree to first send the other a written notice of dispute ("Notice") and to attempt in good faith to resolve the dispute for at least 60 days after the Notice is received (the "Informal Resolution Period"). A Notice to us must be sent to FindYourDomain.com, Attn: Legal – Notice of Dispute, 4616 W Sahara Ave #180, Las Vegas, NV 89102, with a copy to contact@findyourdomain.com. A Notice to you will be sent to the most recent email and/or mailing address you have provided to us. The Notice must include (a) the claimant's name, address, email, and telephone number; (b) a description of the nature and basis of the claim; (c) the specific relief sought; and (d) the claimant's personal signature (or, for an entity, the signature of an authorized officer). If either party is represented by counsel, the party must also sign a statement authorizing the counsel to represent them and to disclose the claim to the other party. During the Informal Resolution Period, either party may request an individual telephone or video conference to discuss resolution, and both parties (and their counsel, if any) will personally participate. Completing this process is a condition precedent to starting arbitration or litigation, and a court or arbitrator may enjoin the filing or prosecution of any arbitration or lawsuit that does not comply with it. All applicable statutes of limitations and filing-fee deadlines are tolled during the Informal Resolution Period. This Section does not prevent either party from seeking relief in small claims court as described below, and it does not require a party to disclose privileged information.
14. Arbitration Agreement and Class Action Waiver (Users Who Are Not California Residents)
This Section 14 applies to you only if you are not a California Resident. "California Resident" means an individual whose primary residence is in California, or an entity whose principal place of business is in California, at the time you accept these Terms or at the time a dispute arises. If you are a California Resident, Section 15 applies to you instead and nothing in this Section 14 applies to you.
14.1 Agreement to arbitrate
Except as provided in Sections 14.3 and 14.9, you and FindYourDomain agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Services, our communications with you, or our relationship, including the formation, existence, breach, termination, enforcement, interpretation, validity, or scope of this arbitration agreement (a "Dispute"), whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether arising before or after your acceptance of these Terms, will be resolved exclusively by final and binding individual arbitration rather than in court. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. ("FAA"), and evidences a transaction involving interstate commerce. Disputes arising under a Transaction Agreement are governed by that agreement's dispute resolution provisions, if any; otherwise this Section 14 applies.
14.2 Rules, administrator, and procedure
The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or, if you are a business, its Commercial Arbitration Rules) and, where applicable, its Mass Arbitration Supplementary Rules, as in effect when the arbitration is filed (the "AAA Rules"), except as modified by this Section 14. The AAA Rules are available at www.adr.org. If the AAA is unavailable or unwilling to administer the arbitration consistent with this Section 14, the parties will agree on a substitute administrator, and if they cannot, a court of competent jurisdiction will appoint one. There will be a single arbitrator, who must be a retired judge or an attorney with at least ten years of experience, selected under the AAA Rules. The arbitrator may award on an individual basis any relief that would be available in court under applicable law, and must follow applicable law and these Terms. Any hearing will be held by video conference unless the arbitrator decides an in-person hearing is necessary, in which case it will be held in the county where you reside or another mutually agreed location. The arbitrator will issue a reasoned written decision. Judgment on the award may be entered in any court of competent jurisdiction. Payment of filing, administrative, and arbitrator fees will be governed by the AAA Rules, except that we will pay those fees in excess of the amount you would pay to file a lawsuit in court, unless the arbitrator finds that your claim was frivolous or brought for an improper purpose, in which case the AAA Rules on fee allocation apply. Each party bears its own attorneys' fees unless applicable law or these Terms provide otherwise.
14.3 Exceptions: small claims and intellectual property
Either party may bring an individual claim in small claims court in the county where you reside (or, for FindYourDomain, Clark County, Nevada) if the claim qualifies and remains in that court on an individual basis. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or to prevent unauthorized access to or abuse of the Site, pending the outcome of arbitration.
14.4 Delegation
The arbitrator, and not any court, has exclusive authority to resolve all Disputes, including any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court of competent jurisdiction (and not an arbitrator) will decide (a) any dispute about the enforceability or interpretation of the class action and representative action waiver in Section 14.5; (b) any dispute about the interpretation or application of the mass arbitration procedures in Section 14.7; (c) whether a party has complied with Section 13; and (d) whether you are a California Resident for purposes of Sections 14 and 15.
14.5 Class action and representative action waiver
YOU AND FINDYOURDOMAIN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS (EXCEPT AS PROVIDED IN SECTION 14.7) AND MAY NOT PRESIDE OVER ANY FORM OF CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF (INCLUDING INJUNCTIVE OR DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF WARRANTED BY THAT PARTY'S INDIVIDUAL CLAIM. If a court decides that applicable law precludes enforcement of any part of this Section 14.5 as to a particular claim or request for relief (such as a request for public injunctive relief), then that claim or request for relief, and only that claim or request, will be severed from the arbitration and litigated in court under Section 16, and all other claims and requests for relief will be arbitrated. In that event, the parties agree that the court litigation will be stayed pending the outcome of the individual arbitration.
14.6 Thirty-day right to opt out
You may opt out of this arbitration agreement by sending written notice to contact@findyourdomain.com or to the mailing address in Section 13, with the subject line "Arbitration Opt-Out," within 30 days after you first accept these Terms (or, if we later make a material change to this Section 14, within 30 days after the change takes effect). Your notice must include your name, address, the email address you used to contact us, and a clear statement that you want to opt out of arbitration. If you opt out, this Section 14 will not apply to you, but Section 13, Section 15.2 (court forum), and all other provisions of these Terms will continue to apply. Opting out has no other effect on your rights under these Terms.
14.7 Mass arbitration procedures
You and FindYourDomain agree that these procedures apply if 25 or more arbitration demands are filed or threatened against FindYourDomain that raise similar claims and are brought by or with the assistance of the same or coordinated counsel or organizations within a 180-day period ("Mass Arbitration"), to provide a fair and efficient way to resolve those claims:
- Administration and fees. The AAA Mass Arbitration Supplementary Rules and their fee schedule apply. Counsel for the claimants and for FindYourDomain must each certify under penalty of perjury that each demand complies with Federal Rule of Civil Procedure 11(b) and that Section 13 has been completed for each claimant. No filing, administrative, or arbitrator fees are due for any demand until the AAA confirms these certifications and the claimant is assigned to a proceeding under this Section 14.7.
- Bellwether proceedings. Counsel for the claimants and counsel for FindYourDomain will each select 10 demands (20 total) to proceed first in individual arbitrations (the "Bellwether Proceedings"). All other demands will be held in abeyance, and no fees will be assessed on them, until the Bellwether Proceedings are concluded. If a party fails to make its selections within 30 days of being asked, the AAA will make them. The Bellwether Proceedings will be conducted before different arbitrators unless the parties agree otherwise. All statutes of limitations and filing deadlines for claims held in abeyance are tolled from the date the demand was first submitted to the AAA until the claim is resolved or released under this Section 14.7.
- Global mediation. Within 90 days after the last Bellwether Proceeding is decided, the parties will participate in a non-binding global mediation of all remaining demands before a mediator selected by agreement or, failing agreement, appointed by the AAA. FindYourDomain will pay the mediator's fees.
- Court option for remaining claims. If the remaining demands are not resolved in mediation, then either you or FindYourDomain may elect, by written notice within 60 days after the mediation concludes, to have your remaining claims decided in a court of competent jurisdiction under Section 16 rather than in arbitration. If no party makes that election, remaining demands will proceed to individual arbitration in staggered batches of no more than 20 at a time, selected in the same manner as the Bellwether Proceedings. Section 14.5 (class action and representative action waiver) continues to apply to any claim litigated in court under this paragraph, to the fullest extent permitted by law.
- Precedence. This Section 14.7 controls over any contrary AAA rule. A court, not the arbitrator or the AAA, will decide disputes about its interpretation and application. If a court finds any part of this Section 14.7 unenforceable, the remainder of Section 14 remains in effect, and the AAA Mass Arbitration Supplementary Rules will govern the issue instead.
14.8 Confidentiality and no precedential effect
The parties will keep arbitration proceedings, filings, and awards confidential except as needed to enforce an award, to comply with law, or as otherwise agreed. No arbitration award or decision will have any preclusive effect on issues or claims in any dispute with anyone who is not a named party to the arbitration.
14.9 Changes to this Section; survival; severability
If we change this Section 14 after you accept these Terms, the change will not apply to any Dispute for which a Notice was already given, and you may reject the change by opting out under Section 14.6 within 30 days after it takes effect, in which case the version of this Section 14 you most recently accepted will continue to apply. This Section 14 survives the termination of your relationship with us. Except as provided in Sections 14.5 and 14.7, if any part of this Section 14 is found unenforceable, the remainder will be enforced to the fullest extent permitted by law.
15. Dispute Resolution for California Residents
15.1 No arbitration
If you are a California Resident (as defined in Section 14), Section 14 does not apply to you, and you are not required to arbitrate any Dispute with us.
15.2 Exclusive forum
Subject to Section 13, any Dispute between a California Resident and FindYourDomain that is not resolved informally will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you and FindYourDomain each consent to the personal jurisdiction of, and venue in, those courts and waive any objection based on inconvenient forum. Notwithstanding the foregoing, either party may bring an individual claim in small claims court in the county where you reside if the claim qualifies, and FindYourDomain may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or the Site.
15.3 Jury trial waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FINDYOURDOMAIN EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES.
15.4 Class action waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FINDYOURDOMAIN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. This Section 15.4 does not waive any right to seek public injunctive relief under California law to the extent such a waiver would be unenforceable. If a court determines that this Section 15.4 is unenforceable as to a particular claim, it will be severed only as to that claim, and the remainder of these Terms will remain in effect.
15.5 California consumer notice
Under California Civil Code § 1789.3, California users are entitled to the following notice: The Site and Services are provided by FindYourDomain.com, 4616 W Sahara Ave #180, Las Vegas, NV 89102. No fees are charged for use of the Site; fees for brokerage and acquisition services are set out in the applicable Transaction Agreement. To file a complaint regarding the Site or Services or to receive further information, contact us at contact@findyourdomain.com or +1 (800) 968-1968, or contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
16. Governing Law and Venue for Court Proceedings
These Terms and any Dispute are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, except that Section 14 is governed by the FAA. Subject to Sections 14 and 15, any court proceeding arising out of or relating to these Terms, the Site, or the Services will be brought exclusively in the state or federal courts located in Clark County, Nevada, and the parties consent to personal jurisdiction and venue there. Nothing in this Section deprives you of the protection of mandatory consumer protection laws of the jurisdiction where you reside that cannot be waived by contract.
17. Time Limit on Claims
To the fullest extent permitted by law, any claim arising out of or relating to these Terms, the Site, or the Services must be filed within one year after the claim accrues, or it is permanently barred. This Section does not apply to claims that applicable law does not permit to be shortened by agreement, and it does not shorten the time for California Residents to bring claims under California laws that prohibit such shortening.
18. Termination and Changes
Termination. We may suspend or terminate your access to the Site or Services at any time, with or without notice, for any reason, including a violation of these Terms. Sections 3, 4, 6, 8, and 10 through 20 survive termination.
Changes to these Terms. We may modify these Terms from time to time. When we do, we will post the revised Terms on the Site and update the "Last Updated" date. For material changes, we will provide additional notice, such as a prominent statement on the Site or an email to the address we have on file for you, at least 30 days before the change takes effect, except that changes required by law or that address new features may take effect immediately. Changes to Sections 14 or 15 are subject to Section 14.9. Your continued use of the Site or Services after a change takes effect means you accept the revised Terms; if you do not agree, you must stop using the Site and Services. Disputes arising before the effective date of a change are governed by the version of these Terms in effect when the Dispute arose.
19. General Provisions
Entire agreement. These Terms, together with the Privacy Policy and any Transaction Agreement, are the entire agreement between you and FindYourDomain regarding the Site and Services and supersede all prior understandings on that subject.
Severability. Except as otherwise stated in Sections 14 and 15, if any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including to an affiliate or in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. Except for the FindYourDomain Parties, who may enforce Sections 10 through 12, there are no third-party beneficiaries of these Terms.
Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of registrars, registries, or ICANN; internet or hosting failures; or governmental action.
Electronic communications and signatures. You consent to receive communications from us electronically, and you agree that electronic communications and records satisfy any legal requirement that they be in writing. Clicking a button or checkbox indicating acceptance, or continuing to use the Site after notice of these Terms, constitutes your electronic signature.
Export and sanctions. You will comply with all applicable U.S. export control and sanctions laws in connection with the Services.
Headings; interpretation. Headings are for convenience only. "Including" means "including without limitation."
